1. What HealthQR is
HealthQR provides a digital service that lets you create an emergency information profile accessible by scanning a QR code. HealthQR is an information service only. It is not a medical provider, medical device, ambulance service, or emergency dispatcher, and it does not provide medical advice, diagnosis, or treatment. Scanning a HealthQR code is not a substitute for calling emergency services.
2. Your responsibility for your information
You are solely responsible for the accuracy, completeness, and currency of the information in your profile, including medical details, emergency contacts, and any documents you upload. HealthQR does not verify, and is not responsible for, the content you enter. You agree to keep your information up to date. Reliance on profile information by any responder or third party is at their own discretion.
3. The three access levels
Your profile has three layers. Level 1 is publicly visible to anyone who scans your code. Level 2 is intended for verified first responders. Level 3 is a private vault released only by the method you configure (password or designated party). You control what information appears at each level. You acknowledge that Level 1 information you mark public may be viewed by anyone who scans your code, and you should not place information there that you do not wish to be public.
4. Responder access
HealthQR may grant Level 2 access to individuals who represent themselves as first responders or event medical staff and are approved by HealthQR. HealthQR makes reasonable efforts to verify such individuals but does not guarantee the identity, credentials, or conduct of any person granted access.
5. Subscriptions, billing, and cancellation
HealthQR is offered on an annual subscription that renews automatically until cancelled. Prices are shown at checkout. Optional upgrades are billed in addition to the base subscription. You may cancel at any time through your account; cancellation stops future renewals. Fees already paid are non-refundable except where required by law. If your subscription lapses, your profile may become inactive and your code may stop returning information.
6. Stickers and hardware
HealthQR may ship adhesive QR stickers. Placement, durability, and legibility depend on how and where you apply them. HealthQR is not responsible for stickers that are damaged, removed, obscured, or unscannable. You are responsible for ensuring your code remains scannable.
7. No guarantee of outcome
HealthQR does not guarantee that any code will be scanned, that any responder will access your information, that information will be available in any given location or network condition, or that any particular medical outcome will result. The service is provided on an as-is and as-available basis.
8. Limitation of liability
To the maximum extent permitted by law, HealthQR and its owners are not liable for any indirect, incidental, or consequential damages, or for any injury, death, or loss arising from use of or reliance on the service, inaccurate profile information, unavailability of the service, or the conduct of any person who accesses a profile. Total liability is limited to the amount you paid in the prior twelve months.
9. Changes and governing law
HealthQR may update these terms; material changes will be communicated. These terms are governed by the laws of the state in which HealthQR is organized. [Entity, state, and dispute-resolution clause to be inserted per counsel.]
